Third party complaint and litigation numbers against professionals are increasing





Complaints against professionals (whether as an individual practitioner or as part of a firm) have not increased in number overall but third party complaints are up 5%. Regardless of whether we are found to be incompetent or negligent, the time, cost and personal exertion involved in addressing and resolving these complaints is considerable.

No one is immune. All practitioners stumble and make mistakes some times. This course will share the experiences of the presenters and their colleagues with a view to helping us all learn from each others mistakes.

Demands on us are high in terms of client and third party expectations. The matters that we deal with are complicated and often the rules are difficult to apply in any given circumstances. When under pressure for a quick answer we can make mistakes. Other times we are under pressure to give the answer the client wants, not what is allowed within the rules.

It’s these day to day things that are becoming hard. Managing risk with expectation, correct answers against "right” answers, and having our actions stand up under scrutiny requires sound practices, precedents and processes. Identifying areas of risk before the complaint arises will help us be better.

The webinar series will focus on helping you put practices and protocols on place to minimise your risk. We will work through a number of scenarios around structuring choices of business, losses, Look-Through Companies and Qualifying Companies, GST adjustments, Trust distributions and the treatment of trusts with offshore parties, as well as succession planning, amongst other things. We will consider the impact for rural clients as well as commercial ventures.

We will provide the following to take away:
1. Checklists and suggestions as to how to best manage issues as they arise
2. A list of documents/records that should be maintained
3. A casebook with discussion points on the issues and options for dealing with them

Jarod is recognised as an industry leader in the area of foreign investments and regularly assists other accountants/advisors with their clients. He provides commercial, practical, tax advice in a wide range of areas including international tax, land transactions, foreign investments and superannuation schemes, restructuring and business sales/acquisitions.
